Promote-Records.com is a service for artists. It connects artists who create music with artists who play music.

This following contract represents the complete agreement between you and Promote-Records.com in regards to the use of Promote-Records.com.

Certain information is required for your registration on Promote-Records.com (such as user name, password and a valid email address). You agree to enter your current, complete and exact registration data at the time of registration and to update these, if necessary, in order to assure that the information remains current, complete and exact. Promote-Records.com can declare your account as well as any rights to use this service for null and void, if parts of your information are inexact, wrong or incomplete. You agree that Promote-Records.com stores your registration data and uses it to book invoice amounts for services used by you, if applicable, from your PayPal Account or your credit card.

You carry sole responsibility for the contents you publish on Promote-Records.com. You carry sole responsibility that all contents you publish on Promote-Records.com, and all information you send other users, do not violate any valid data protection laws. This includes that you obtain prior consent from all persons whose personal information you use or publish on Promote-Records.com.

You are responsible for storing information and invoices you need for the purpose of preserving evidence, bookkeeping, etc., on a storage medium independent of Promote-Records.com.

Promote-Records.com does not carry any responsibility and neither explicit nor implicitly warrants the correctness and reliability of the content published by the artist on Promote-Records.com. The contents published by the artist do not necessarily reflect the opinions or the terms of Promote-Records.com. Profiles and applications of third parties that are created and published by members of Promote-Records.com may possibly include links to other websites. Promote-Records.com is not responsible for the correctness or the opinions expressed on such websites. Promote-Records.com does not necessarily check or monitor the correctness or completeness of such websites. The existence of websites linked to Promote-Records.com does not lead to any conclusions as to the approval or endorsement of the linked websites by Promote-Records.com. If you access such third-party websites, then you do so at your own risk. Promote-Records.com does not take on any responsibility for advertisement or applications of third parties that are published on Promote-Records.com. Promote-Records.com also carries no responsibility for goods or services offered by such advertising agencies. Promote-Records.com is not responsible for the online or offline behavior of artists of Promote-Records.com. Promote-Records.com does not carry any responsibility for errors, negligence, deletions, defects, delays in operation or transfer, failure in communication lines as well as theft or destruction or unauthorized access to or change of messages of the artists. Promote-Records.com is not responsible for problems or technical disturbances in connection with telephone nets or lines, online systems, servers or providers, computer equipment and software as well as failure with emails or players due to technical problems or data jam in the Internet. This also includes a violation or damage to artists or computers or which result from participation or downloading of materials in connection with Promote-Records.com. Under no circumstances is Promote-Records.com liable for loss or damage due to use of Promote-Records.com, participation in an event from Promote-Records.com, artist contents that are published on or via Promote-Records.com, or due to online or offline behavior of the artists. The service from Promote-Records.com is made available as is. Promote-Records.com expressly does not issue any guarantee as to the suitability for a certain purpose or non-violation. Promote-Records.com does not guarantee specific results in connection with the use of Promote-Records.com.

Under no conditions is Promote-Records.com liable towards you or third parties for indirect, consequential, intensified, incidental or concrete damages, including those damages due to a profit lost in connection with the use of Promote-Records.com, even if Promote-Records.com was advised of the possibility of such damages. Irrespective of contrary terms in this contract, the liability of Promote-records.com is, due to any causes and independent of the nature of the claim, always limited to the amount paid to Promote-records.com for services on Promote-records.com.

Promote-Records.com does not claim any property right on lyrics, files, pictures, photos, videos, sounds, musical compositions, copyrighted material, applications or other materials (overall "content") that you, as creator on Promote-Records.com, publish for other artists. After publishing contents on Promote-Records.com, you still keep all rights, subject to the valid limited license here that you have on your content. With your publication ("post") of content on Promote-Records.com you grant Promote-Records.com a limited license to use, modify, delete elements, publicly show, reproduce and spread the content on Promote-Records.com. In addition, you give us the right to depict your content in email notifications and newsletters, in order to inform other artists about your work. This limited license does not, however, give Promote-Records.com the right to sell or divest in any manner your content outside of Promote-Records.com. Your license ends along with your promotion on Promote-Records.com.

You agree that the release projects you generated that have the status of "new" for longer than three months are automatically deleted by Promote-Records. Please also remember that you yourself can delete projects or take them offline only if they have the status "new".

The license you grant Promote-Records.com is a simple (meaning, you can also grant others a license to your contents, aside from granting it to Promote-Records.com), nonpaid license and free of charge (that means, that Promote-Records.com does not pay or need to pay for use of the contents published by you on Promote-Records.com) and a worldwide license (since the Internet is offered globally).

Promote-Records.com respects the intellectual property rights of others and asks the same of you. Uploading, embedding, publishing, mailing, transferring or other means of making material available that may violate copyright, patents, brands, company secrets or other protected rights of natural or legal persons is prohibited. Promote-Records.com has the right to terminate the membership of infringers.

You guarantee, declare and assure that:

(I) you are the owner of the content you are publishing on Promote-Records.com;

(II) the publication of your content on Promote-Records.com does not violate any valid laws, including, among others, data protection laws, intellectual property rights, copy rights, contractual or other rights of natural or legal persons. You obligate yourself to pay all license fees or other fees that you owe natural or legal persons due to your publication of contents on Promote-Records.com.

Promote-Records.com can decline your content due to any reasons, can refuse to publish it or delete it. This also includes content, which, according to the sole judgment of Promote-Records.com, violates this contract or is objectionable or illegal or violates the right of natural or legal persons or injures to other natural or legal persons or threatens their safety. Promote-Records.com does not take on any responsibility for the monitoring of services of Promote-Records.com on inappropriate content or inappropriate behavior. Even if Promote-Records.com decides at any time and at its own discretion to monitor the services of Promote-Records.com, Promote-Records.com nevertheless still does not take on any responsibility for the content or change or removal of inappropriate content and behavior of the artist who published the content.

You agree to exempt Promote-Records.com, its subsidiaries and affiliated companies as well as its partners, executive staff, representatives, partners and employees and indemnify them in regards to loss, liability, demands or claims, including reasonable legal costs asserted by third parties due to or in connection with the use of Promote-Records.com or a violation of this contract or a violation of the guarantees and assurances you made within the framework of this contract or if a content published on Promote-Records.com leads to Promote-Records.com being liable towards a third party.

If you believe that your or somebody else's work has been copied in a way that constitutes copyright infringement, please report your notice of infringement to Promote-records.com.

With the creation of an account with Promote-Records.com, you give Promote-Records.com permission to contact you at your email address.

With the use of the Promote-Records.com website you declare that you agree to this contract. This is also reinforced by your membership. This contract represents the complete agreement between you and Promote-Records.com in regards to the use of Promote-Records.com. If Promote-Records.com refrains from practicing or implementing a right or regulation in this contract, this is not considered to be a waiver of such a right or regulation. Promote-Records.com is a brand of Promote-Records.com. This contract applies to the greatest extent allowed by law. If conditions in this contract are unlawful, invalid or not enforceable, then these are separated from the contract and have no effect on the validity and enforceability of the remaining conditions.
